Level of study required: Bachelor's degree in any social/human sciences. A law degree is a plus.
Job Description:
The Bankruptcy Paralegal supports clients throughout the bankruptcy process by managing case preparation, documentation, filings, and post-filing follow-up.
This role is responsible for maintaining accurate case progression, ensuring compliance with court and trustee requirements, and providing consistent client communication.
The Bankruptcy Paralegal works under attorney supervision and does not provide legal advice or court representation.
Responsibilities:
• Case Prioritization & Intake:
• Review assigned cases daily to identify urgent matters, including wage garnishments and pending lawsuits.
• Prioritize urgent cases to minimize ongoing financial harm to clients.
• Client Communication & Support:
• Initiate contact with newly assigned clients to introduce the process and explain next steps.
• Maintain ongoing communication via phone, text, and email to address questions and concerns.
• Proactively follow up with each active client at least once per week to ensure timely document submission.
• Schedule calls or appointments as needed to support case progress.
• Document Collection, Review & Analysis:
• Request, collect, organize, and verify all required client documentation, including but not limited to:
• Pay stubs
• Tax returns
• Bank statements
• Identification documents
• Vehicle titles and property records
• Business registration documentation
• Conduct case reviews to:
• Verify prior bankruptcy filings
• Confirm business registration status
• Perform vehicle and property appraisals
• Review large transactions and asset transfers
• Ensure documentation accuracy and completeness to prevent delays or deficiencies.
• Petition Preparation & Filing:
• Enter accurate client financial information into bankruptcy preparation software.
• Prepare and review bankruptcy petitions for completeness and accuracy.
• File petitions with the court according to case type:
• Two-stage filing for bifurcated cases
• Full filing for traditional cases once payment requirements are met
• Maintain a target of consistent monthly filings aligned with firm goals.
• Payment Plans & Financial Tracking:
• Create and manage autodebit payment plans for bifurcated clients.
• Ensure clients complete and sign required payment authorizations.
• Track payment status and follow up on discrepancies as needed.
• Case Tracking & Compliance:
• Maintain an internal case checklist, updated daily, tracking:
• Document status
• Payment progress
• Upcoming deadlines
• Next required actions
• Ensure all legal and procedural deadlines are met.
• Court & Trustee Coordination:
• Send 341 Meeting notices and instructions to clients after petition filing.
• Upload required supporting documents to court and trustee portals.
• Respond promptly to court or trustee requests for additional information by coordinating with clients and submitting updates.
• Third-Party & Post-Filing Communication:
• Contact banks, creditors, and third parties on behalf of clients to:
• Notify them of bankruptcy filings
• Request cessation of collection activity
• Obtain required documentation when clients are unable to do so
• Maintain communication with trustees following the 341 meeting to address additional requirements.
Skills:
• Strong organizational and time-management skills
• 1 - 2 years in bankruptcy is a must
• High attention to detail and accuracy
• Ability to manage multiple cases simultaneously
• Professional client communication skills
• Understanding of bankruptcy workflows and deadlines
• Ability to work with sensitive financial and personal information
